Purpose and acceptance
These terms and conditions of use (the “Terms”) govern access to the Atsaman website (the “Site”) and the use made of it. Browsing the Site amounts to full acceptance of the Terms in force at the time of the visit. If you do not accept them, please do not use the Site.
Access to the Site
The Site is freely accessible and requires no account. Internet access and equipment costs remain yours.
We endeavour to keep the Site available at all times but cannot guarantee it. Access may be interrupted, in particular for maintenance, updates or in the event of force majeure, without notice or compensation. The association may change, suspend or withdraw all or part of the Site and its contents.
Editorial content
Atsaman is a journal devoted to artistic and critical practices emerging from the Global South, diasporas and postcolonial territories. The published content — texts, interviews, essays, images, cultural programme, stockists — is provided for information.
Despite the care taken in preparing it, we cannot guarantee that it is complete, accurate and up to date at all times. The dates, venues and details of the cultural programme are those of their organisers and may change without our being informed; the availability of the journal at stockists is a matter for the stockists themselves.
Intellectual property
The structure of the Site, its texts, photographs, illustrations, logotype and typographic and graphic choices are protected by intellectual property law. They remain the property of the ATSAMAN association or of their authors, contributors and rights holders, who have licensed their use for the purposes of the Site.
Under Articles L.122-4 and L.335-2 of the French Intellectual Property Code, any representation, reproduction, adaptation, translation or exploitation, in whole or in part, by any means and on any medium, without prior written authorisation, is unlawful and constitutes an infringement offence. The exceptions provided for by law remain reserved, in particular private copying and short quotation, provided the source and the author’s name are clearly stated.
The name “Atsaman”, the logotype and the titles of the journal are distinctive signs of the association; any unauthorised use is prohibited. Requests for authorisation — reproducing a text, an image or an extract, educational or editorial use — should be sent to contact@atsamanpublications.com.
Prohibited uses
You undertake to use the Site in accordance with the law and with these Terms. The following are prohibited in particular:
- any attempt to gain unauthorised access to the systems hosting the Site, and any action liable to disrupt its operation or alter its content;
- the automated, bulk or substantial extraction or re-use of the content and databases of the Site, including for the purpose of training automated systems;
- the commercial use of the content without prior written authorisation;
- the reproduction of the Site or of its layout in a way liable to create confusion as to the origin of the content.
Hyperlinks
The Site links to third-party sites — stockists, partners, institutions, social networks. These links are offered for convenience: the association exercises no control over those sites and accepts no liability for their content, their availability or their practices.
Linking to the Site is free for non-commercial use, provided it creates no confusion as to the origin of the content. We reserve the right to request the removal of a link.
Liability
The Site is made available as is. To the extent permitted by law, the association cannot be held liable for any direct or indirect damage arising from access to the Site, its unavailability, its use or the inability to use it, including loss of data or damage to your equipment. It is for you to take appropriate measures to protect them.
Nothing in these Terms excludes the liability of the association in the event of wilful misconduct or gross negligence, nor the rights granted to consumers by law.
Personal data
The Site sets no cookies and uses no trackers. The only data you can send us from the Site is your email address, if you choose to subscribe to the newsletter. The processing of data carried out during your visit is described in our privacy policy.
Accessibility
We aim to make the Site readable and usable by as many people as possible: contrast, keyboard navigation, alternative text for images, and respect for system preferences on reduced motion. If you run into an obstacle, report it to contact@atsamanpublications.com and we will fix what can be fixed.
Changes to the Terms
The association may amend these Terms at any time. The version that applies is the one online on the day of your visit; the date of the last update appears under the title.
Governing law and disputes
These Terms are governed by French law. In the event of a disagreement, please write to us at contact@atsamanpublications.com so that we can seek an amicable solution. Failing agreement, the dispute will be brought before the competent French courts. If you are acting as a consumer, you retain the benefit of the mandatory provisions of the law of your country of residence and the right to bring proceedings before the courts of your place of residence.
